Terms and conditions.
1. General
These Terms and Conditions (“T&C”) are entered into by and between You (hereinafter: “the Client”, “you”) and Heather Turnbach - OutFit Women’s Movement (hereinafter: “OutFit”, “our”, “us”, or “we”) including, but not limited to, the use of this website (www.outfitwomensmovement.com) (the “Website”) and/or the purchase and use of any and all products and services from us.
Please read these terms of use carefully before you start to use the Website. By using our Website or making a booking/purchase, the Client accepts these terms of use and agrees to abide by them in their totality. If you do not agree to these terms of use, please do not use the Website or book/purchase a product or service from us.
2. Programs and services
OutFit offers private and group outdoor courses, programs, and services (“Service”) by Heather Turnbach (“the Leader”).
The programs, courses, prices are described on the Website and in related marketing material. Unless specified the costs of transport, insurance, food and drinks are not included.
For reasons of safety (including risks due to unexpected problems in the outdoors, bad weather, or participants’ capabilities) or force majeure, the Leader reserves the right to modify the Service. Claims for damages because of a Service change are excluded.
All Website and Service content is protected by copyright laws and cannot be used for commercial purposes by others. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
3. Liability
Your safety is our #1 priority. However, we cannot guarantee 100% safety given that there are natural risks inherent in the outdoors, even with careful planning and guiding. When you book a Service, you explicitly recognize and accept these risks.
For all outdoor Services, good health, a fitness level matched to the planned program, and appropriate equipment are required. It is your responsibility to inform us of any possible risks of a medical nature that concern you. If these conditions are not met, we reserve the right to exclude you from the Service.
4. Insurance
It is the Client’s responsibility to be appropriately insured for illness, accident, emergency evacuation from the mountains (recommended), and civil liability.
5. Payment
We require payment prior to the Quick Fix Call Service. For some group Services, we may require a small non-refundable deposit to reserve your spot. Your satisfaction is important to us. Therefore, all other Services will be invoiced to the Client after the Service is fulfilled. If you are unhappy and/or found no value with our Services, you are not obligated to pay.
6. Cancellations and reimbursements
If we need to cancel a Service for any reason, you will be fully reimbursed but will not be entitled to additional compensation.
A cancellation of the booked Service by the Client must be submitted in writing or electronically. The date we receive the cancellation will be the determining factor for the calculation of the cancellation costs.
If you cancel your participation after the registration deadline, the following costs apply:
Within 30-20 days before the booked Service: 30% of the total amount
Within 19-10 days before the booked Service: 50% of the total amount
Within 9-0 days before the booked Service: 100% of the total amount
7. COVID safety
OutFit is part of Switzerland Tourism’s ''Clean & Safe'' campaign and follows the recommended safety and hygiene measures issued by the Federal Office of Public Health (FOPH) and the State Secretariat for Economic Affairs (SECO).
In accordance with the Federal Council’s directives, we will accept only participants who:
are not infected with Covid-19 or have been cured of it for 14 days;
are not undergoing a medical evaluation for Covid-19 infection;
have no symptoms of a disease that has not yet been diagnosed (cough, fever, etc.);
are not aware of any acute Covid-19 infections in their immediate environment (family members, roommates, co-workers, etc.).
We reserve the right to exclude from the Service any participant who does not meet one or more of these criteria.
It is the Client’s responsibility to bring a mask and hand sanitizer to any in-person Services. We will also maintain the recommended distance (2 meters) as much as possible throughout the Service.
After any in-person Service, it is the Client’s responsibility to let the Leader know as quickly as possible if you have a suspected or confirmed infection with COVID so that necessary steps can be taken to inform others and help with contact tracing.
8. Website usage and data privacy
We respect your privacy and are committed to protecting your personal data. Any personal information that you provide is used for business purposes only and information is maintained in accordance with data protection regulations. All personal information you share with us remains confidential and will never be shared with unauthorized third parties. By using our Website, you agree and consent to our use of your data and accept our Privacy Policy.
9. Photos/videos and other imagery
OutFit, its trip leaders, and OutFit-authorized third parties reserve the right to take photographs or videos during the operation of any service or part thereof and to use the resulting photography, videos, or recordings for promotional or commercial use. By reserving/booking an OutFit service, the participant agrees to allow their likeness to be used by OutFit and OutFit-authorized third parties, without compensation to the participant. If the participant prefers that their likeness not be used, they must notify OutFit in writing prior to commencement of the course/event.
9. Revisions
We may revise these terms of use at any time by amending this page or by provisions or notices published elsewhere on our Website.
10. This is a legal binding contract
I have read and fully understand these terms and conditions and am fully aware of its content and context. I understand that this is a legal contract and that this is a release of liability. In submitting a reservation, I agree to the terms and conditions set forth above.
11. Jurisdiction
In the event of a dispute, Zürich, Switzerland, shall be the place of jurisdiction and Swiss law shall apply.
